Derivative Works and Video Reposting Guideline

Thank you very much for your continued support of “AStars production”.
“AStars production” (hereinafter referred to as “the production company”) actively supports derivative creative activities by individual customers using the copyrighted works of tour production company.
As a production company created together with our fans, we would like to provide the “AStars production Derivative Works and Video Reposting Guideline” (hereinafter referred to as “the guideline”) so that everyone can enjoy derivative works activities without any worry.
Regarding derivative works by individual customers involving our production company or the members who appear in it, our production company will not claim copyright infringement, so long as such activities comply with this guideline and are carried out within the scope of individual fan activities.
If you engage in derivative works or video reposting of the original content of this production company, you will be deemed to have agreed to this guideline. If you do not agree to this guideline, you will not be able to engage in derivative works or video reposting, so please read and abide by this guideline when producing your work.

Definitions
In this guideline, original works, derivative works, and video reposting are defined as follows:
Original contents: All works to which the production company holds the rights, such as image files, scenarios, and music produced and released by this production company.
Derivative works: An act of creatively expressing your own thoughts or feelings (hereinafter referred to as “derivative creation activities”) or creative works (hereinafter referred to as “derivative works”) by individuals using knowledge obtained from this production as part of their fan activities. Please note that this does not include mere modifications of primary creative content that have no originality.
Video reposting: The act of creating videos (hereinafter referred to as “reposted videos”) that use the member images, videos, audio, etc., which are the original creative content provided by this production company, especially parts of live broadcasts, and add audio and text, including so-called “cut-out videos.” Note that reposted videos refer to videos that use the images, videos, audio, etc., of the members of this production, so they include both derivative works and simply altered original content with no creative element.

Permitted scope of derivative works (original works only)
The derivative works that our production company accepts are those created by individuals or groups without legal personality based on the primary creative content provided by our production company. Specifically, the creation and various operations of illustrations, doujinshi, manga, novels, etc. as creative works, and the creation of cosplay costumes and various activities involving cosplay, etc. as activities are subject to this.
Regarding the distribution of derivative works, our production company allows it within the scope of non-profit fan activities, with the exception of video reposting. In addition to complying with this guideline, we would appreciate it if you would also do so within the scope of general etiquette.
“The scope that is recognized as non-profit fan activity” refers to cases that meet all of the following requirements:
Carrying out activities without the aim of making a profit
Distributing the work free of charge, or receiving only a small amount of compensation equivalent to the cost of production, such as the cost of raw materials, if any.
The content is used for hobby purposes only and is not used to advertise other content, products, or services.
Please note that creations that are done as a hobby and do not generate revenue from the final product are recognized as non-profit fan activities. The following are some typical examples:
Cosplay activities that do not involve photo sales, etc.
Printing onto car bodies, etc., without the need for any photo sales. However, the use of original content is not permitted.
However, for the following activities, please contact our production company in advance even if you do not generate any revenue. (via Website inquiry link)
Non-profit fan activity that uses derivative content to advertise on screens at train stations and areas around town.

Prohibited matter
The following actions are strictly prohibited:
Even if an act falls under the definition of derivative works, if it falls under any of the following, it will not be considered a derivative work approved by our production company. If you do not comply with these rules, we may contact you individually to request royalties as stipulated by our company or to stop derivative works.
1. The work is used for profit-making purposes with a high business potential, regardless of whether it is paid or not
* Regarding doujin activities, only those that meet all of the above criteria will be considered exempt
2. Directly using the original content of this production (illustrations, videos, audio, music, etc.) in a derivative work (copyright infringement)
*This guideline does not permit the use of official images (illustrations, logos, etc.), videos, audio, music, etc. in any form, whether it is a direct use of original content or one with simple, uncreative modification.
3. Any activity that damages or is detrimental to the image of our production company or the original content (including any activity that deviates from the brand or image of our production company)
4. Activities that are deemed to be in violation of the laws and regulations or public order and morals of any country, or that exceed socially acceptable limits
5. Any action that infringes or may infringe on original content or the rights of third parties
6. Use of original content or derivative works that contains violent, grotesque, or sexual content
7. Making statements that may lead to the misunderstanding that the content is official content of our production company
8. Activities that may lead to discrimination on grounds such as race, belief, religion, gender, social status, etc.
9. Using original content or derivative works to promote a particular belief, religion, or political stance
10. Republishing original content on video sharing sites or other media without permission
11. Any other content that the production company deems to be beyond the scope of derivative creative activities

Rules for reposting videos related to this production, clippings, etc
Regarding the posting of reproduced videos, we will permit such posting as long as it is recognized as non-profit fan activity.
However, please comply with the following conditions.
1. Activities will be limited to those that do not fall under any of the prohibited acts listed below. For example, posting videos that are simply cuts from the original video or broadcast is prohibited.
2. For posted videos, please include the original video or live URL in the video information
3. When posting a reposted video, please make sure to post it at least one hour after the original live broadcast has ended.
We may request the deletion of any “reposted videos” that do not comply with these rules.
If the reproduced video contains content for which our production company does not hold the copyright or other rights, please comply with the terms of use and other provisions of the content rights holder. Please note that our production company will not respond individually to inquiries regarding interpretations of third party terms of use and other provisions.
This guideline does not apply to membership-only videos, ticketed live videos, and other paid content, and is therefore prohibited unless special permission is given for the paid content in question.

Use of derivative works or reposted videos by this production company
Please note that any derivative works or reproduced videos that are made public may be used free of charge by our production company, such as by featuring them in our live streaming or on social media.
If our production company decides to use derivative works as officially distributed products or make merchandise, the creator of the work will be contacted individually.
In addition, please use the X (Twitter) hashtags designated by each member when publishing your derivative works, as this will make it easier for the members of our production company to access your derivative works and reposted videos. However, please note that even if you do not use the hashtags when publishing your derivative works, we may still use them as listed above.

To All Corporate Customers
This guideline applies only to individuals or organisational units without legal personality (including doujin groups, circles, etc.) who create derivative works or reproduced videos as non-profit activities.
This guideline does not apply if the main entity is a corporation (including cases where the main entity is essentially a corporation, such as when the production costs are borne by a corporation even if the work is made in an individual’s name).
